Terms of Service
The terms governing use of this website and the general terms for our design, build out and service work.
Updated September 22, 2026
These Terms of Service ("Terms") govern your access to kitchenpalmbeach.site and describe the general terms under which Kitchen Services of the Palm Beaches Inc provides commercial kitchen design, build out, equipment and service. By using this website or engaging our services you agree to these Terms.
1. About Us
Kitchen Services of the Palm Beaches Inc is a commercial kitchen contractor located at 8353 Raymond Dr, Boynton Beach, FL 33472, serving Palm Beach County and selected neighboring areas.
2. Website Use
- Use this site for lawful purposes only.
- Do not attempt to disrupt, damage or gain unauthorized access to the site.
- Do not copy, scrape or republish site content, project photographs or drawings without written permission.
- Do not submit false information or use our forms for unsolicited commercial messages.
3. Information Is Not An Offer
Prices, ranges, equipment costs, timelines and descriptions on this website, including those on the homepage, pricing page and equipment page, are general information for planning. They are not quotes, offers or guarantees. Equipment pricing in particular moves with manufacturer pricing and freight.
4. Proposals
- Proposals are based on the conditions observed at the site visit and the information you provide.
- Each written proposal states an expiration date, commonly 30 days, because equipment pricing changes.
- Allowances, exclusions and assumptions stated in the proposal control over anything said verbally or shown on this website.
- Only a proposal accepted in writing by both parties creates a binding agreement.
5. Deposits And Payment
- A deposit is required to release equipment orders and custom fabrication.
- Equipment deposits become non refundable once the manufacturer order is placed, because equipment ordered to your specification cannot be returned without restocking charges or at all.
- Build out projects run on the milestone schedule set out in your proposal.
- Design fees are invoiced at engagement and on delivery, and are credited against a build out contract signed with us within 12 months.
- Service contracts are invoiced monthly and may be cancelled with 30 days written notice.
- Past due balances may accrue interest and collection costs as permitted by Florida law.
6. Drawings And Intellectual Property
Drawings, layouts, equipment schedules and specifications we produce remain our intellectual property. They are provided for the purpose of reviewing and building your project with us, and may not be used to solicit competing bids or to have the work performed by another contractor without our written permission and payment of the applicable design fee.
7. Permits And Licensed Work
Work requiring a permit is performed under permits obtained by the appropriately licensed contractor of record for that trade, and electrical, plumbing, gas, mechanical and fire suppression work is performed by appropriately licensed trades. Permit, impact and utility company fees are separate from our fees and are paid to the agency or utility. We prepare and package drawings for plan review and manage revisions, but we do not control agency processing times or outcomes.
8. Concealed Conditions
Existing buildings hide things. Conditions discovered once walls, ceilings or floors are opened, including structural problems, undersized or non compliant utilities, water damage, mold, asbestos, unpermitted prior work or blocked drain lines, are outside the base proposal. Where such a condition materially changes the work, it is priced and approved in a written change order before work continues.
9. Change Orders
Any change to scope must be approved in writing before it is performed. We do not perform extra work and invoice for it afterward. Changes may affect both price and schedule.
10. Client Responsibilities
- Provide access to the site on scheduled work days
- Approve drawings and equipment selections by the dates in the schedule
- Obtain landlord, HOA or property manager approvals where required
- Provide adequate power, water and safe working conditions during construction
- Coordinate other trades not within our scope
- Maintain the operating licenses required for your food service business
11. Scope And Other Trades
Unless stated in your proposal, our scope does not include structural modification, fire sprinkler system changes, grease interceptor installation outside the kitchen footprint, utility company service upgrades, dining room or front of house finishes, exterior work, signage or permitting fees.
12. Schedule
Timelines are good faith estimates measured from permit issuance and approved drawings, not from first contact. Equipment lead times, agency processing, inspection scheduling, site readiness, other trades and weather all affect schedule. We communicate changes as soon as we are aware of them, and we do not promise an opening date that depends on a permit we do not control.
13. Inspections
We prepare our work to pass inspection and we attend inspections on projects we build. We do not control inspectors or the outcome of an inspection, and we are not responsible for delays caused by agency scheduling, by other trades' work, or by conditions outside our scope.
14. Warranty
Warranty terms are described on our Warranty and Service page and in your written agreement.
15. Limitation Of Liability
To the maximum extent permitted by Florida law, our total liability for any claim is limited to the amount paid for the work giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including lost revenue, delayed opening, lost product, business interruption or the costs of other trades.
16. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including hurricanes, severe weather, flooding, power loss, material or equipment shortages, manufacturer delays, labor disruption or government action.
17. Governing Law
These Terms are governed by the laws of the State of Florida. Disputes shall be brought in the state or federal courts located in Palm Beach County, Florida, unless your agreement provides otherwise.
18. Changes And Contact
We may revise these Terms at any time. Changes take effect when posted with an updated date. Where a signed agreement conflicts with these Terms, the agreement controls for that project.
